OVERVIEW This website is operated by Pacific West Cedars (a registered trade name of 1102357 BC LTD). Throughout the site, the terms “we”, “us” and “our” refer to Pacific West Cedars. Pacific West Cedars offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein.

SECTION 1 - LIVING PLANT POLICY & QUALITY GUARANTEE We take pride in growing and supplying premium, farm-fresh trees. We guarantee that all trees will arrive in healthy, satisfactory condition. If your trees arrive in an unsatisfactory state, you must notify us immediately upon delivery or pickup. We will replace the affected trees at our cost.

Because we are dealing with living agricultural products, all sales are final once delivery or local pickup has been completed and accepted. We do not offer refunds for trees that have been planted, as we cannot control the soil conditions, watering schedules, or ongoing environmental care once the trees leave our possession.

SECTION 2 - EXCHANGES & LOGISTICS We encourage all customers to verify their tree type (e.g., Thuja Green Giant, Hicks Yew) and sizing before completing their purchase. If you order the incorrect trees and notify us before delivery, we will gladly adjust your order.

SECTION 3 - LOCAL PICKUP & DELIVERY RULES We offer local pickup at our Chilliwack, British Columbia nursery, as well as distance-based delivery.

  • Local Pickup: Customers selecting local pickup must ensure they have a suitable vehicle or trailer to safely transport large, heavy trees. Pacific West Cedars is not liable for any damage to customer vehicles during the loading process, nor for wind or transport damage to trees once they leave our lot.

  • Delivery: Delivery fees are calculated based on weight (pallet capacity) and distance. The customer is responsible for ensuring the delivery location is accessible for our delivery vehicles.

SECTION 4 - ACCURACY OF BILLING AND ACCOUNT INFORMATION We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

SECTION 5 - PRODUCTS AND PRICING Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. We have made every effort to display as accurately as possible the colors and images of our products; however, we cannot guarantee that your computer monitor's display of any color will be accurate.

SECTION 6 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Our corporate operations are based in Chilliwack, British Columbia under 1102357 BC LTD.

SECTION 7 - CHANGES TO TERMS OF SERVICE You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
